Goods are warranted only to the extent of the express warranty of
the manufacturer represented thereof and to the extent such is enforceable
by Seller. No warranty either expressed or implied is made by seller as
to the fitness, merchantability, condition, capacity, or efficiency of any
goods sold, and no claims for labor or for consequential damages will be
allowed.
The Seller shall be notified promptly of any material claimed to be defective,
and such material shall be subject to inspection by the Seller. Seller will
acknowledge shipments in error for a time period not to exceed 60 days from
the original shipping date.
No material may be returned for credit or
replacement without prior authorization.
A restocking charge will be made on all returns authorized by the Seller
for reasons other than Seller's responsibility, providing the merchandise is
received in saleable, readily restockable condition.
No claim made hereunder by the Purchaser, whether as to goods delivered or
for non-delivery shall be greater than the purchase price of the goods in
respect of which such claim is made, and Lesman Instrument Company shall
under no circumstances be liable for consequential damages.
No statement
or recommendation made or assistance given by the Seller or its
representatives to the Buyer or its representatives, in connection with the
use of any products by the Buyer, shall constitute a waiver by the Seller of
any of the provisions hereof or effect the Seller's liability, as herein
defined. Any attempt by an unauthorized person to alter or repair any part
of the goods shall immediately invalidate all warranties.
There are no
understandings or agreements between the Buyer and the Seller relative
hereto which are not fully expressed herein, and no change made herein shall
be valid unless it is made in writing and signed by both parties.
